Terms of service
In force from
These terms set out what the site offers, how to use it and post on it, and how to complain. They are our terms of service under the Polish Act on Providing Services by Electronic Means and our terms and conditions under the EU Digital Services Act. You can save or print this page at any time.
The operator
This site, quietpicnic Good Games, is run, and its services are provided, by the operator named below ("we"):
- Full name
- Jakub Łepek
- Postal address
- ul. Pocztowa 8/6, 78-500 Drawsko Pomorskie, Poland
Write to contact@quietpicnic.com about anything concerning the site; the contact page explains what to include.
That address is also our single point of contact for users and authorities under the EU Digital Services Act; you can write in English or Polish.
Our services
All our services are free of charge. We provide:
- browsing the site: our games, devlogs, team pages and release notes;
- game demos to play in the browser, with cloud saves kept for a guest or for an account;
- accounts, created with an email address and a password or by signing in with Discord or Google;
- public profiles with a display name and a profile picture, listed in the player directory unless you make yours private;
- comments under devlog posts, which you can also write without an account, under a nickname;
- the forum for account holders: threads, replies, bug reports and screenshots;
- upvotes for posts, comments, threads and replies, which add up to each author's karma.
Technical requirements and risks
You need a device with internet access and a current version of a common web browser with JavaScript and cookies turned on; the games also need WebAssembly and WebGL, and the browser demos may not run on every device. To create an account you need an email address, or a Discord or Google account.
Like any service on the internet, the site carries general risks, such as malware, phishing, or someone taking over an account protected by a weak or reused password. Use a password you use nowhere else, keep your browser up to date and never share your password: we will never ask you for it.
The privacy notice lists the cookies and other data the site stores in your browser, and what they are for.
Starting and ending the agreement
By using the site you accept these terms, and posting confirms it. An agreement for the services that need no account is made when you start using them, and ends when you stop. An account agreement is made for an indefinite period when your account is created: by ticking the terms box on the sign-up form, or by continuing with Discord or Google, you accept these terms.
You must be at least 16 years old to create an account or to post comments, forum posts or other content.
You can end the agreement at any time without giving a reason: stop using the site, or delete your account on the account page. Deleting the account erases your profile, profile picture, cloud saves, votes and screenshots; your comments and forum posts stay, shown as from a deleted account, unless you delete them first.
We may end an account agreement for an important reason, such as closing the site or a change in the law that stops us providing the service, with 30 days' notice by email. We may end it at once if you seriously or repeatedly break these terms, as described under Moderation.
Rules for content and conduct
You are responsible for what you post, and you must not provide unlawful content. These are our prohibited content rules: a report names the rule it is about, and every moderation decision states the rule it applies. None of the following is allowed:
- Illegal content: anything illegal under EU or Polish law, such as threats, incitement to violence or hatred, defamation, child sexual abuse material or terrorist content;
- Child sexual abuse material: any picture, video or other material that shows a child in sexual activity or presents a child in a sexual way. You can report it without giving your name or email address;
- Harassment or hate: insults, personal attacks, intimidation, or attacking people for who they are, such as their origin, religion, gender or sexual orientation;
- Spam or scams: advertising, scams, links to malware, or posting the same thing over and over;
- Personal data or privacy: sharing someone else's personal data or private information, such as their address, phone number or photos of them, without their permission;
- Intellectual property: content that infringes someone else's copyright, trade mark or other rights, such as pirated games or art used without permission;
- Another breach of the rules: pornography or graphic violence; pretending to be someone else, the team included; or disrupting the site: flooding it, attacking its security, signing up or posting with automated tools, or getting around a limit or a measure we applied.
These rules apply to usernames, display names, profile pictures and screenshots too.
Your content
You keep all rights to what you post. You give us a free, non-exclusive licence, without territorial limits and for as long as the content stays on the site, to record and copy it on our servers and in backups, to adapt it technically (for example to resize a picture), and to make it available on the site so that anyone can access it at a place and time of their choosing, together with the name you post under. We use this licence only to run the site.
The licence ends when the content is deleted from the site; copies in backups disappear as the backups rotate out. Post only content you have the right to share.
Moderation
The team reviews content by hand: content that is reported to us or that we come across ourselves. Automated checks only refuse input that breaks technical rules, such as posting or signing in too often, names with control characters or names reserved for the team, and keep out bots; they never remove content, and every decision about content itself is made by a person.
Anyone can report a comment, a public profile, or a forum thread, reply or screenshot that they believe is illegal or against these terms: with the Report button next to it, or by email to contact@quietpicnic.com, giving the link to the content. A report names the rule it concerns, explains why the content breaks it, and states that you believe in good faith that the report is accurate and complete. Without an account you also give your name and email address, and may have to solve a captcha; with an account you may leave them out, and we then write to the account's email address. A report of child sexual abuse material needs no name or email address. You can send up to 10 reports an hour with an account, or 5 without one, and no more than 20 an hour can come from one network address. We confirm that we received your report, decide on it in a timely, careful and objective way, and tell you what we decided.
Depending on how serious a breach is and whether it repeats, we may remove content; close a thread or the comments under a post; restrict a public profile by hiding it from other players, deleting its picture and resetting its display name to the username; ban an account for a time or for good, so that it can no longer sign in; or delete the account. If we find no breach, we take no action. We choose a measure in proportion to the breach, with due regard to the rights and legitimate interests of everyone involved, including freedom of expression.
When we remove or restrict your content or your account, after a report or on our own initiative, we tell you by email, if we have your address: what we did and to which content, the facts and the rule or law behind it, whether automated means were used, and how you can challenge the decision. For now, our emails about reports and moderation decisions are in English.
You can appeal any of our moderation decisions free of charge, within six months of being told about it: reply to the email that told you about it, or write to contact@quietpicnic.com. A person reviews every appeal, and we tell you the outcome and our reasons without undue delay. You can also turn to an out-of-court dispute settlement body certified under Article 21 of the Digital Services Act, or go to court.
If we learn of information that gives rise to a suspicion of a criminal offence threatening someone's life or safety, we promptly inform the police or the public prosecutor of the country concerned.
Complaints
You can complain about the site, for example when a service does not work as these terms describe, by email to contact@quietpicnic.com. Describe the problem and give an email address for our answer. We answer within 14 days of receiving the complaint.
As a consumer you may also use out-of-court ways of resolving a complaint. Your national consumer protection body can tell you which are open to you; in Poland, for example, a municipal or district consumer ombudsman or a voivodeship inspectorate of the Trade Inspection can help, and the website of the Office of Competition and Consumer Protection, uokik.gov.pl, explains them.
Availability and liability
We do our best to keep the site running, but it may be unavailable at times, for example during maintenance or updates. We announce planned breaks on the site in advance where we can.
The site and its demos are provided free of charge and as they are; demos are unfinished games, and we cannot promise that saves will never be lost. We are liable under the generally applicable law. Nothing in these terms limits the rights you have as a consumer under mandatory law.
Personal data
How we process personal data is described in the privacy notice.
Governing law and disputes
These terms are governed by Polish law. If you are a consumer, you keep the protection that the mandatory law of the country you live in gives you. Disputes are settled by the courts that have jurisdiction under the general rules.
Changes to these terms
We may change these terms for an important reason, such as a new service, a change in the law or in the site, or the need to prevent abuse. We announce a change on the site, and by email to account holders, at least 14 days before it takes effect. If you do not accept it, you can delete your account before then; from that day on, the new terms apply.
